2. User Waiver

Given the speculative nature of cryptocurrency and the evolving technology of smart contracts, users acknowledge that human error is inherent throughout the development process. Yeti-Apes undertakes testing and due diligence to mitigate potential human error during the development of the Yeti-Apes platform; however, it cannot guarantee exclusively that smart contracts will perform as expected. Users recognize the possibility of human error in smart contract development.

All domains and associated subdomains hosted by Yeti-Apes are provided "as is" and "as available."

Users acknowledge that Yeti-Apes cannot guarantee exclusively the safety and security of user assets within the Yeti-Apes platform due to potential future targeted attacks or other malicious acts against the platform. Consequently, users agree that:

Any Yeti-Apes collaborators or representatives are not liable for any loss, malfunction, theft, hack, exploitation, or other breaches of any or all of users' digital assets resulting from the use of the Yeti-Apes platform or supporting smart contracts across all supported networks.

Yeti-Apes is indemnified against any financial or legal claim arising from a breach of security, loss, malfunction, theft, hack, exploitation, or other breaches of the Yeti-Apes platform or supporting smart contracts across all supported networks resulting in the loss of users' digital assets.

Yeti-Apes will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if Yeti-Apes has been advised of the possibility of these damages), resulting from your use of the Yeti-Apes domains and associated subdomains and their content. Under no circumstances will Yeti-Apes' total liability of all kinds arising out of or related to your use of the yetiapes.info domain and associated subdomains or their content (including but not limited to warranty claims), regardless of the forum and regardless of whether any action or claim is based on contract, tort, or otherwise. Each provision of these terms that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is intended to and does allocate the risks between the parties under this user agreement. This allocation is an essential element of the basis of the bargain between the parties. Each of these provisions is severable and independent of all other provisions of these terms. The limitations in this section will apply even if any limited remedy fails for its essential purpose. Users of the Yeti-Apes platform do so at their own risk and agree that they understand the risks associated with using decentralized applications, smart contracts, and cryptocurrency in general.

Yeti-Apes is not responsible for the maintenance and security of user wallet addresses. Users agree that the availability of the Yeti-Apes platform may be occasionally limited without notice due to maintenance, repairs, updates, or other necessary development requirements and waive the right to make claims against Yeti-Apes for any losses during periods of downtime. Users are responsible for and aware of slashing loss concerning locked tokens within staking contracts. Users also understand that there is no dedicated support service for the Yeti-Apes platform.

Yeti-Apes is not responsible for any third-party products and their performance concerning their connectivity and compatibility with the Yeti-Apes platform.
